TERMS & CONDITIONS

PLEASE READ EVERYTHING BEFORE BOOKING.

Contracted Package: 

Includes all services described in the selected package details reviewed and distributed to clients. Any additional services/products requested by the client and incurred by the consultant will be billed directly to the client at cost. All services contracted cannot be deducted, but additional services can be added.

For your convenience, you can make payments to the Consultant through HoneyBook.

 

Provided Documentation:

All documentation created and provided to the client is owned and copyrighted by Consultant and cannot be used or given to any other 3rd party.

 

LIability

It is understood that Consultant is only liable for services completed and provided by Consultant and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Consultant be liable for consequential damages of any kind.

 

Cancellation Policy

If the event is canceled, no portion of the fees paid to Consultant will be returned. If the event is postponed, services contracted can be applied to a new date , if available (refer to the Postponement Policy).

Postponement Policy:

If the event is postponed, all services will cease at the time of notification of postponement if no determined new date is provided. The payment schedule will be determined and readjusted post the new event date notification. 

 

Responsibility:

Consultant is not responsible for Acts of God, Natural Disasters, an Act of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e., accident, death in the family, illness, pregnancy, or sudden, tragic circumstance. In such a situation, the consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill the consultant’s obligations under the contract, at no additional charge to the client.

 

Overtime:

Additional unplanned and/or un-contracted services (such as any extension of time, services outside of the scope of agreement day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $130 per hour.

 

Damage or Loss of Accessories:

Client agrees to exercise all due care in caring for and preserving the property of Consultant. Clients shall remain responsible for all loss or damage, including actual replacement value, for each missing or damaged item per cost.

Payment Schedule and Method:

For your convenience, payments can be made online via HoneyBook.com using a valid credit card.

$150.00 initial retainer due upon completion of the signed agreement for services. The remaining balance is due as indicated in the schedule below:

 

Attorney:

If legal action is necessary to enforce the terms of this contract, the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled.

Appropriate Conduct/ Safe Working Environment: 

The Client(s) expressly agree(s) to take best efforts to provide [Vendor] and Vendor’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either [Vendor] or a bystander to present a threat or implied threat of injury or harm to [Vendor] staff or equipment, the [Vendor] reserves the right to cancel all services remaining under this Agreement and leave the event. At the [Vendor]’s discretion, the [Vendor] may enact a three-strike policy.

After the first offense, the [Vendor] will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/can respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), [Vendor] shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the [Vendor] will immediately leave the event. If the [Vendor] leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold [Vendor] harmless as a result of incomplete event coverage, or for a lapse in the quality of the [Vendor’s] work, and the Client(s) shall be responsible for payment in full.


Deposits & Payments :
-Deposits are a non-refundable one-time payment that is used as a booking and cancellation fee.
-Final payments are due no later than 5:00 pm the DAY BEFORE your scheduled session. 
- If you fail to pay by the required time, this will result in a non-refundable session cancellation. 
-If your session is canceled due to non-payment, you will be notified via email. 
-In the event a client cancels a session, the client will not be refunded. 
-If you do not like your photos, you will NOT be reimbursed for a session or your session cost.

Session Photo Retrieval:
-Session images are provided based on the length provided in the session package. 
-If you have a package that includes a book, the client has 3 weeks from the date that he/she receives the online portfolio to select and notify the Olivia B. team of the photos that he/she wants printed/selected. If the client does not use this time slot, the team will select photos for the client, and the order will be processed.
-Photo books take up to 5 weeks.

Travel Fee: 
-There will be an additional $75 added to your session cost for any sessions that are more than an hour (60 miles from the metro-detroit area. 
-Please select this option at the time of booking, or it will be added by our administration and reflected in your session confirmation. 

Session Props: 
-This is NOT a set/prop-based company. The extras and props that we offer will be listed during booking. This constantly changes. 
-There are certain props that we will allow you to bring. Please get confirmation from us before booking your scheduled appointment. 

Social Media/Website Usage: 
-The photographer may or may not use session photos on social media platforms and the company website. In the event that you do not want your photos used for these purposes, please notify the photographer before the session is completed.

Session Tardiness: 
-If you are late, this takes away from your session time, and you will not be guaranteed any reimbursed time.
-In the event the photographer reimburses time or stays beyond the booked time, there will be a fee to gain access to the photos that were taken after your appointment time. 
-If you are late more than 15 minutes with no notification to the photographer, your session will be cancelled with no reimbursement. 
-Please remember it is up to the photographer's discretion if you're reimbursed for any time that you have missed.
-In the event the Photographers are late, you will be reimbursed for the amount of time that was missed.

Confirmations/Reminders: 
-Confirmation emails will be sent to you after booking. Please allow 1-2 business days. 
-Confirmations will also be sent anytime a payment is made. Please allow 1-2 business days.
-CONFIRM all sessions via email. 

Session Rescheduling: 
-If there is inclement weather on the day of the session and the session needs to be rescheduled, the photographer will notify you via text
-The session will be scheduled for the FIRST available slot that is open. 
-If there is a government shutdown and the session cannot be completed, the client will be refunded in full. The refund will be provided AFTER an attempt to reschedule the session. If this isn’t possible or is not wanted by the client, then the client will receive a refund. 

Olivia B. Photography Prohibits: 
-Smoking of any kind is prohibited while on the grounds of Olivia B. Photography. 
-The Olivia B. Photography staff reserves the right to decline service to any client if anything about the session is deemed inappropriate, offensive, or goes against our core company values. The use or display of guns (fake or real), gang signs, threatening or offensive language/hand gestures, or similar entities is not allowed.
- When a minor is not accompanied by an adult, the Olivia B. Photography staff reserves the right to decline service to any underage client if the attire is deemed inappropriate for a minor.
